Article 1 - Purpose

These Terms of Service (TOS) govern access to and use of the CyberScore platform, a security scanning and vulnerability analysis service offered by Patrick Astoul (Individual Entrepreneur).

Using CyberScore implies full acceptance of these Terms of Service.

Article 4 - Service Description

CyberScore is a SaaS platform that offers:

  • Complete security scans: analysis of 12 security modules (Email, HTTP, WebApp, API, DNS, Cloud, Container, IAM, Attack Surface, Vulnerabilities, OSINT, Compliance)
  • Shadow IT Discovery: detection of unauthorized cloud assets across 73+ cloud providers
  • PDF reports: generation of compliance reports (GDPR, ISO 27001, NIS2, SEC)
  • Scan history: tracking of security evolution
  • Management dashboard: web interface to view and manage your scans

Article 5 - Registration and Account Creation

To use CyberScore, you must:

  • Create an account by providing accurate and up-to-date information
  • Be at least 18 years old
  • Use the service for professional purposes only
  • Not share your login credentials
  • Maintain the security of your password

You are responsible for all activities performed from your account.

Starter Plan - $49 USD

Professional Plan - $99 USD/month

  • Unlimited domain scans
  • Complete Shadow IT Discovery
  • In-depth vulnerability scanning
  • Compliance reports (GDPR, ISO 27001, NIS2)

Enterprise Plan - Custom Quote

  • Whitelabel reports (customized with your logo)
  • Dedicated support
  • Custom integration (API)
  • Custom scan volume

Prices are displayed in USD excluding taxes. Applicable VAT will be added at checkout.

Article 7 - Payment Terms

  • Accepted payment methods: Credit card only (Visa, Mastercard, American Express) via Stripe
  • Billing: monthly for Professional subscriptions, per-scan for Starter
  • Renewal: automatic unless canceled before due date
  • Invoice: sent by email after each payment

Article 8 - Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, you have a period of 14 days from subscription to exercise your right of withdrawal, without justification or penalty.

Refunds will be processed within 14 business days following the request.

Article 9 - Subscription Cancellation

You can cancel your subscription at any time from your dashboard or by contacting us at patrick@cybersco.re.

  • Cancellation takes effect at the end of the current billing period
  • No pro-rata refund is provided
  • You retain access until the end of the paid period
  • Your data is retained according to our Privacy Policy

Article 10 - User Obligations

By using CyberScore, you agree to:

  • Legal use: use the service only for legitimate and lawful purposes
  • Authorized domains: scan only domains you own or for which you have written authorization
  • Respect limits: not exceed your plan limits (number of scans for Starter)
  • No abuse: not use the service to overload our servers (DoS) or attempt to bypass limitations
  • Confidentiality: not share your login credentials
  • Accurate data: provide accurate information during registration

⚠️ Any fraudulent or abusive use will result in immediate account suspension without refund.

Article 11 - Service Availability

CyberScore commits to providing a service available 24/7 with an availability target of 99.5% (excluding scheduled maintenance).

  • Scheduled maintenance will be announced in advance by email
  • We do not guarantee complete absence of interruptions
  • No compensation is due for temporary service interruptions

Article 12 - Intellectual Property

All elements of the CyberScore service (software, databases, graphics, texts, logos) are protected by copyright, trademark law, and database rights.

  • You have a personal and non-exclusive right of use
  • Any unauthorized reproduction, representation, modification, or extraction is prohibited
  • Generated reports belong to you
  • The name "CyberScore" and logo are registered trademarks

Article 13 - Limitation of Liability

What CyberScore Provides

CyberScore is an automated security analysis platform that scans your digital assets and generates reports identifying potential vulnerabilities, misconfigurations, and security weaknesses. Our reports are designed to provide actionable intelligence to support your security decision-making process.

Your Responsibilities

You are solely responsible for:

  • Reviewing and validating all findings before taking action
  • Determining which security measures are appropriate for your organization
  • Implementing remediation actions based on your risk assessment
  • Maintaining ongoing security monitoring and updates
  • Consulting with qualified security professionals when needed

Limitations

CyberScore provides information and analysis, not security assurance. Our automated scans may not detect all vulnerabilities, and findings may include false positives or miss certain attack vectors. This tool complements—but does not replace—comprehensive security audits, penetration testing, or expert security consultation.

WARRANTY DISCLAIMER

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

CYBERSCORE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL VULNERABILITIES WILL BE DETECTED. USE AT YOUR OWN RISK.

Limitation of Damages

IN NO EVENT SHALL CYBERSCORE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

No absolute guarantee: We do not guarantee detection of all vulnerabilities

Decision support tool: CyberScore does not replace a cybersecurity expert or comprehensive security audit

Scanned data: You are responsible for ensuring you have authorization to scan the domains you submit

Service interruptions: We are not liable for damages caused by temporary interruptions, third-party failures, or force majeure events

Article 14 - Export Control and Sanctions Compliance

CyberScore is a cybersecurity tool subject to export control regulations. By using this service, you represent and warrant that:

  • You are not located in, or a resident of, any country subject to US, EU, or French trade sanctions (including but not limited to: Cuba, Iran, North Korea, Syria, Crimea region)
  • You are not listed on any government restricted parties list (US SDN List, EU Consolidated List, etc.)
  • You will not use CyberScore for any military, nuclear, missile, or chemical/biological weapons purposes
  • You will comply with all applicable export control laws and regulations

⛔ Violation of export control laws may result in immediate account termination and reporting to relevant authorities.

Article 15 - Indemnification

You agree to indemnify, defend, and hold harmless CyberScore, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your scanning of unauthorized domains or systems
  • Your violation of any law, regulation, or third-party rights
  • Any actions taken based on CyberScore reports without proper validation

This indemnification obligation survives termination of these Terms.

Article 16 - Class Action Waiver

WAIVER OF CLASS ACTIONS AND COLLECTIVE RELIEF

You agree to resolve any disputes with CyberScore on an individual basis only, and you waive any right to participate in a class action lawsuit or class-wide arbitration.

Each party may bring claims against the other only in their individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

Note: This clause may not be enforceable in all jurisdictions. If any part of this waiver is found unenforceable, the remainder remains in effect.

Article 17 - Consumer Mediation (EU/French Customers)

For customers located in France or the European Union, in accordance with Article L.616-1 of the French Consumer Code, you may contact a consumer mediator in case of dispute that cannot be resolved directly with CyberScore:

Note: This mediation procedure only applies to customers residing in France or the European Union. US customers should refer to Article 16 (Class Action Waiver).

Article 18 - Personal Data

Processing of your personal data is governed by our Privacy Policy, compliant with GDPR.

Article 19 - TOS Modifications

CyberScore reserves the right to modify these TOS at any time. Modifications will take effect upon publication on the site.

Users will be notified by email of significant modifications. Continued use of the service constitutes acceptance of the new TOS.

Article 20 - Applicable Law and Jurisdiction

These Terms are governed by and construed in accordance with French law, regardless of your location or country of residence.

Applicable law: French law

Exclusive jurisdiction: You expressly agree that any dispute arising from these Terms shall be exclusively resolved by the Paris Courts (France), and you waive any objection based on inconvenient forum.

Language: In case of translation, only the French version is authoritative

By using CyberScore, you acknowledge that this service is provided from France by a French company, and you accept that French law governs this relationship.
